If the List Type/Service Type
section of the MLS listing indicates that
it is an open listing/entry only listing (i.e., OP/EO), you
should conduct all negotiations with and present all offers
directly to the Seller, as EZ List does not
represent the Seller unless we have procured a buyer.
In such instance, the “SO Comp”
specified in the MLS listing indicates the amount of commission
that the Seller will pay to the Buyer’s Agent directly.
EZ List is in no manner responsible or liable
for such payment. You may wish to submit forms CAR
CA and CAR SNA 11 along with your
offer so that you have a written agreement directly with the
Seller codifying the amount of commission the Seller will
pay and that you are not representing the Seller.
Please note that while you should negotiate directly with
the Seller, per MLS rules you should notify
EZ List when a property is “pending”
and when it has closed so that the MLS listing
may be updated in a timely manner.
